Terms of Engagement

These general terms apply to enquiries made through this website and to advisory engagements with Dr O. Data Governance Advisory, prior to and except where superseded by a specific signed engagement agreement or statement of work.

1. Scope of services

Services are provided on the basis of a scoped proposal agreed in writing prior to commencement of paid work. An initial consultation is provided free of charge and without obligation, and does not itself constitute an engagement.

2. No legal advice

Dr O. Data Governance Advisory provides governance, privacy, records management, AI governance and certification architecture advisory services. We are not a law firm and do not provide legal advice. Where legal advice is required, clients should engage a qualified legal practitioner; we are glad to work alongside legal counsel as part of a broader engagement.

3. Confidentiality

Information shared with us in the course of an enquiry or engagement is treated as confidential and is not disclosed to third parties without consent, except where required by law.

4. Fees and payment

Fees, payment terms and milestones are set out in the scoped proposal for each engagement. No work beyond the agreed scope is billed without prior written agreement.

5. Intellectual property

Unless otherwise agreed in writing, frameworks, documents and materials developed specifically for a client during an engagement become the property of that client on full payment. Pre-existing methodologies, templates and general know-how developed prior to or independent of the engagement remain the property of Dr O. Data Governance Advisory.

6. Limitation of liability

To the extent permitted by law, our liability for any claim arising from services provided is limited to the fees paid for the specific engagement giving rise to the claim. Nothing in these terms excludes any right or remedy that cannot lawfully be excluded under the Australian Consumer Law.

7. Governing law

These terms are governed by the laws of Queensland, Australia.

This is a general statement of engagement terms and does not constitute legal advice. Specific engagements are governed by their individually agreed statement of work, which takes precedence over this general statement where the two differ.
